Medios de obtención de Datos Personales

Los datos personales que thesilverxp.com recabe de usted, serán destinados únicamente para los fines descritos en el presente aviso de privacidad y podrán ser recabados:

• De manera directa, ingresando sus datos o utilizando los servicios en línea a través de la página https://thesilverxp.mx
• De manera directa, a través de nuestro centro de reservación telefónica “call center”.
• De manera directa, a través de nuestras cuentas oficiales de redes sociales.
• De manera personal, a través de nuestros representantes de reservaciones.

Datos recabados

Los datos que thesilverxp.com recabe de usted, serán los siguientes: Nombre completo con apellidos, número de teléfono, correo electrónico, domicilio y datos financieros como lo son: Número de tarjeta de crédito, nombre del titular de la misma, fecha de vencimiento, código de seguridad y aquellos datos que resulten necesarios para completar y administrar las reservaciones solicitadas por usted.

Asimismo, thesilverxp.com en casos especiales solicitará recabar su imagen física (fotografía y/o video), para lo cual thesilverxp.com habilitará los medios idóneos para obtener el consentimiento de los titulares de acuerdo a lo establecido en la LFPDPPP y en su reglamento.

Finalidad de los Datos Personales recabados

Sus datos personales serán recabados para las siguientes finalidades principales que son necesarias para el servicio que solicita:

• Procesamiento, seguimiento,   actualización, modificación, cancelación y confirmación de los servicios   por   usted   reservados

thesilverxp.com a través de sus medios, con fines financieros y crediticios, para dar cumplimiento a las obligaciones contraídas con usted y con nuestros proveedores.

• En el  caso  de  reservaciones  que  incluyan transportación aérea, para que la aerolínea pueda contactar proactivamente con el pasajero en caso de interrupción en las operaciones o bien para proporcionar al cliente información actualizada acerca de su Lo anterior implica ciertas ventajas para usted como, por ejemplo:
  • Actualizaciones sobre vuelos en tiempo real.
  • Notificaciones proactivas  en  caso  de interrupción del servicio (cancelaciones, retrasos, etc.).
  • Actualizaciones relacionadas  con  el equipaje.
  • Envío de la información del cambio de reserva o tarjeta de embarque de forma automática, para  los  siguientes  vuelos disponibles.
  • Reducción de tiempo de espera, ansiedad y molestias, durante las interrupciones en el servicio.
  • Una mejor experiencia del cliente.
• Asimismo, los datos que le sean recabados se utilizará para ponerse en contacto con usted para ofrecerles mayor información para la generación de posibles reservas.

Y de manera accesoria, utilizaremos su información personal para las siguientes finalidades que no son necesarias para el servicio solicitado, pero que nos permiten y facilitan una mejor atención:

• Evaluar la calidad del servicio, realizar sondeos sobre hábitos  y  preferencias  de  viaje,  para participar en concursos y sorteos, programas de lealtad, implementación y desarrollo de campañas publicitarias,  así  como  para  el  envío  de promociones,   ofertas,   servicios   y   fines publicitarios  (Única  y  exclusivamente  para thesilverxp.com).

Los titulares de manera inmediata y gratuita podrán en cualquier momento solicitar la cancelación de envío de correos electrónicos con fines publicitarios por parte de thesilverxp.com haciendo click en el link “Cancelar suscripción”.

En caso de que no desee que sus datos personales sean tratados para estos fines adicionales, usted puede presentar desde este momento un escrito vía correo electrónico a la dirección info@thesilverxp.com.

Transferencia de datos, nacional e internacional

En virtud de lo expuesto en los artículos 36 y 37 de la LFPDPPP sus datos personales podrán ser transferidos y/o compartidos a:

1. Sociedades controladoras, subsidiarias o afiliadas bajo el control común de thesilverxp.com, o a una sociedad matriz o a cualquier sociedad del mismo grupo de thesilverxp.com que opere bajo los mismos procesos y políticas internas;
2. Cuando la transferencia sea necesaria por virtud de un contrato celebrado o por celebrar en interés del titular, por el responsable y un tercero;
3. Cuando la transferencia sea precisa para el mantenimiento o cumplimiento de una relación jurídica entre el responsable y el titular tales como los Proveedores,  Proveedores  de  Servicios Turísticos, Instituciones Bancarias y Crediticias, y entre

Es importante señalar que los terceros a los que se transfieran sus datos personales se obligarán en los mismos términos del presente Aviso de Privacidad y cumplirán con las medidas de seguridad y confidencialidad correspondientes.

De cualquier manera, nos comprometemos a no transferir su información personal a terceros sin su consentimiento, salvo en el caso de lo previsto en el artículo 37 de la Ley Federal de Protección de Datos Personales en Posesión de los Particulares, así como a realizar esta transferencia en los términos que fija dicha Ley.

Ejercicio de los Derechos ARCO

El artículo 28 de la LFPDPPP, le otorga cuatro derechos a ejercer:

• El titular tiene derecho a Acceder a sus datos personales que obren en poder del responsable y a conocer el Aviso de Privacidad y sus
• El titular tiene derecho a Rectificar sus datos en caso de  ser  inexactos,  incorrectos  o  estén desactualizados.

• El titular tiene derecho a Cancelar sus datos personales cuando considere que no están siendo utilizados para el cumplimiento de los fines establecidos en el presente Aviso de Privacidad.
• El titular tiene derecho a Oponerse al tratamiento de sus datos personales respecto a alguno de los fines establecidos  en  el  presente  Aviso  de Privacidad.

Derecho de revocar su consentimiento para el tratamiento de datos

El artículo 8 de La LFPDPPP, prevé la posibilidad de revocar el consentimiento otorgado para el tratamiento de sus datos personales. Para revocarlo usted podrá solicitarlo utilizando el mismo mecanismo y procedimiento para el ejercicio de los Derechos ARCO previsto en el presente aviso. No obstante, thesilverxp.com le informa que el mantener sus datos personales en su base de datos, le permitirá entender mejor sus necesidades con base a su historial y con ello ofrecerle un mejor servicio en sus futuras reservaciones.

Mecanismos para el ejercicio de los Derechos ARCO y Revocación del consentimiento para el tratamiento de sus datos

Para ejercer sus derechos de Acceso, Rectificación, Cancelación y Oposición o su derecho a revocar el consentimiento para el tratamiento de sus datos personales, deberá llenar y enviar el  FORMATO DE EJERCICIO DE DERECHOS ARCO, mismo que podrá solicitar y remitir a través del siguiente correo electrónico: info@ thesilverxp.com, o dirigir el formato físicamente a la siguiente dirección: Calle Caimito, Mz 13, Lote 18, SM 25, Cancún, Quintana Roo, C.P. 77509, con atención al Departamento de Protección de Datos Personales, o bien, podrá presentar su solicitud por escrito y en idioma español y cumpliendo con los requisitos señalados en el artículo 29 del reglamento de la LFPDPPP. Para mayor información podrá comunicarse directamente al Departamento de Protección de Datos thesilverxp.com a través de la cuenta de correo electrónico antes indicada.

Para la procedencia del ejercicio de sus Derechos ARCO usted deberá acreditar la titularidad de sus derechos ARCO o bien la representación respecto al titular a través de la presentación de copia de su documento de identificación y la exhibición del original para su cotejo, o aquellos instrumentos establecidos en el artículo 89 del reglamento de la LFPDPPP.

“Artículo 29.- La solicitud de acceso, rectificación, cancelación u oposición deberá contener y acompañar lo siguiente:

I.El nombre del titular y domicilio u otro medio para comunicarle la respuesta a su solicitud;

1. Los documentos que acrediten la identidad o, en su caso, la representación legal del titular;

• La descripción clara y precisa de los datos personales respecto de los que se busca ejercer alguno de los derechos antes mencionados, y

1. Cualquier otro elemento o documento que facilite la localización de los datos personales.”

thesilverxp.com le dará seguimiento a su solicitud en un lapso de 20 días hábiles contados a partir de la recepción de dicho FORMATO o solicitud, con la documentación completa, para comunicarle sobre la procedencia de la misma. En caso de resultar procedente, thesilverxp.com contará con un plazo máximo de 15 días hábiles para hacer efectivo su derecho ARCO.

Medidas para proteger su información y para limitar el uso o divulgación de su información personal Su información personal

The data that thesilverxp.com collects from you, will be the following: Full name with surname, telephone number, email, address and financial data such as: Credit card number, name of the holder of the same, expiration date, security code and those data that are necessary to complete and manage the reservations requested by you.

• Processing, monitoring,   updating,   modifying, cancelling and confirming the services you booked with thesilverxp.com through its means, for financial and credit purposes, to comply with the obligations contracted with you and our suppliers.
• In the  case  of  reservations  that  include  air transportation, so that the airline can proactively contact the passenger in case of interruption in operations or to provide the customer with updated

information about their trip. This implies certain advantages for you, such as:

1. Real-time flight updates.
2. Proactive notifications in case of service interruption (cancellations, delays, etc.).
3. Baggage-related updates.
4. Sending the information of the change of reservation or boarding pass automatically, for the following available flights.
5. Reduction of  waiting  time,  anxiety  and discomfort, during service interruptions.
6. A better customer experience.

• Likewise, the data collected from you will be used to contact you to offer you more information for the generation of possible reservations.

And in an accessory way, we will use your personal information for the following purposes that are not necessary for the requested service, but that allow us and facilitate better service:

For the origin of the exercise of your ARCO Rights you must prove the ownership of your ARCO rights or the representation with respect to the owner through the presentation of a copy of your identification document and the exhibition of the original for comparison, or those instruments established in article 89 of the regulations of the LFPDPPP.

INTRODUCCIÓN.- Bienvenido al sitio de internet https://thesilverxp.mx (“The Silver XP”), denominado como el “Sitio”. El uso que haga de este Sitio está expresamente condicionado a su aceptación de los presentes Términos y Condiciones. Al usar este sitio, manifiesta su consentimiento con los Términos y Condiciones. The Silver XP se reserva el derecho de adicionar o modificar los Términos y Condiciones en cualquier momento. Todos los términos adicionados o modificados causarán efecto en el momento en que éstos sean actualizados. El uso continuo de este sitio incluso posterior a la publicación de los cambios realizados a los Términos y Condiciones significará que Usted acepta dichos cambios. DEFINICIONES.- Para todos los efectos de los Términos y Condiciones aquí establecidos, se entenderán las siguientes definiciones:

AGENCIA DE VIAJES.- Empresa que realiza la comercialización de los servicios a través de plataformas tecnológicas, islas en centros o plazas comerciales, asi como convenciones y/o expos de turismo en diferentes lugares, que contratan y/o actúan como intermediaria a través de sus servicios de reservación, en beneficio de un Usuario-Turista, respecto de los servicios turísticos proporcionados de manera directa por el Proveedor. (En lo sucesivo denominada de aquí en adelante como “The Silver XP”).

https://thesilverxp.mx .- Página web de “The Silver XP” que actúa como intermediaria y como motor de reservaciones, ofreciendo a través del internet al Usuario-Turista, los diversos servicios turísticos que proporciona de manera directa el Proveedor. (En lo sucesivo denominado de aquí en adelante como el “Sitio”).

USUARIO-TURISTA.- Persona que viaja temporalmente y/o que utiliza el sitio https://thesilverxp.mx, con el objeto de hacer uso de la intermediación y el motor de reservaciones de The Silver XP y con el fin último de disfrutar cualquiera de los servicios turísticos proporcionados de manera directa por el Proveedor. (En lo sucesivo denominado de aquí en adelante como “Usted”).

PROVEEDOR.- Persona física o moral que proporciona en forma directa los servicios turísticos a el Usuario-Turista, contratados, reservados o adquiridos por éste último a través de la intermediación y motor de reservaciones del sitio de The Silver XP.

XPEER.- Personal especializado en atención al Usuario-Turista que tiene las funciones, de manera enunciativa mas no limitativa de, realizar reservaciones en restaurantes,  tour,  transportación,  asesoría  de  viaje,  recomendaciones  de actividades turísticas y eventos dentro de diferentes destinos, promoción de servicios turísticos, orientación de servicios médicos, y cualquier otra necesidad.

DECLARACIONES.- Usted declara bajo protesta de decir verdad, compareciendo por su propio y personal derecho y/o a través de su apoderado legal, que es una

persona física o moral, mayor de edad, hábil, capaz y con los medios suficientes ó con  capacitad  económica  para  obligarse  bajo  los  presentes  Términos  y Condiciones, así como con interés en adquirir los servicios de intermediación y reservación que aquí se especifican, y que para ello recurre a The Silver XP a efecto de que funja como mera intermediaria entre Usted y los Proveedores prestadores directos de servicios turísticos.

Usted declara bajo protesta de decir verdad, que reconoce que los servicios proporcionados por The Silver XP y su Sitio, consisten UNICA Y EXLUSIVAMENTE EN LA INTERMEDIACIÓN ENTRE USTED Y EL PROVEEDOR DIRECTO DE LOS

SERVICIOS. The Silver XP S.A de C.V.; declara (a) ser una sociedad mercantil debidamente constituida conforme a las leyes mexicanas. (b) Que cuenta con autorización de la Secretaria de Turismo para prestar servicio de Agencia de Viajes, así mismo se encuentra registrada ante las autoridades Hacendarias con el Registro Federal de Contribuyentes número TSX190427HI7. (c) Que su domicilio se encuentra ubicado en Calle Caimito, Mz 13, Lote 18, SM 25, Cancún, Quintana Roo,

C.P. 77509. (d) Que su objeto social consiste en la facultad para: Actuar como intermediaria para la reservación de espacios en los medios de transporte y expedir de parte de los transportistas y a favor de los turistas los boletos correspondientes;

(e) servir de intermediario entre los turistas y los prestadores de servicios de transportes de cualquier género, en los términos que señalen las Leyes y Reglamentos; reservar a los turistas habitaciones y demás servicios conexos, en hoteles y establecimientos de hospedaje; prestar a los turistas servicios de reservación de sitios de atracción turística; servir de intermediario entre los demás prestadores de servicios turísticos y otras agencias de viajes; proporcionar servicio de información turística y difundir el material de propaganda de esta índole que sea de distribución gratuita. (f) Servir de intermediario entre los demás prestadores de servicios turísticos (incluyendo, de manera enunciativa mas no limitativa, a hoteles, centros de diversión y entretenimiento, excursiones, visitas guiadas y/o renta de todo tipo de vehículos) y otras agencias de viajes (g) Que para efectos de los presentes Términos y Condiciones, únicamente actúa como INTERMEDIARIA entre Usted y los Proveedores de dichos servicios turísticos, y que para tal objeto, cuenta con la capacidad técnica y administrativa, así como con los elementos materiales y humanos necesarios para reservar por cuenta y a petición de Usted los servicios a los que hace referencia estos Términos y Condiciones. (h) Que con base en las Declaraciones que anteceden, acepta los presentes Términos y Condiciones.

OBJETO.- El objeto consiste en la INTERMEDIACIÓN que existirá entre The Silver XP, Usted y los Proveedores, en donde The Silver XP para los efectos de los presentes  Términos  y  Condiciones,  actuará  única  y  exclusivamente como INTERMEDIARIA, proporcionando a Usted a través de su Sitio de manera enunciativa más no limitativa, el servicio de reservación de transporte terrestre, y aérea; reservación en hoteles y establecimientos de hospedaje; reservación de sitios de atracción turística; reservación de paquetes de viajes; entre otros, Así, una vez que las reservaciones le sean confirmadas por The Silver XP conteniendo los servicios turísticos por Usted elegidos (de acuerdo a su disponibilidad), se concluirá con la prestación del servicio de intermediación por parte de The Silver XP, ya que

dichos servicios turísticos serán proporcionados a Usted por los Proveedores de manera directa.

USO DEL SITIO.- The Silver XP le otorga una licencia limitada, intransferible, revocable, para usar este Sitio de acuerdo a los presentes Términos y Condiciones. Usted será el único responsable por cualquier daño que se cause por cualquier violación a los Derechos de Autor, de Propiedad Industrial, o a cualquier otra clase de Propiedad de Derechos, o por cualquier otro daño que se ocasione por el mal uso que usted haga de este sitio.

POLÍTICAS DE RESERVACIÓN, PAGO Y CANCELACIÓN

POLÍTICAS DE RESERVACIÓN.- Las tarifas mostradas en el sitio Web, son solamente válidas al momento de su cotización. Las tarifas aplicarán para su respectivo cargo, solo en caso de reservar el servicio deseado, pues de lo contrario dichas tarifas pueden variar. Una reservación se considera completada, cuando Usted cuenta con un número de confirmación y el cargo correspondiente ha sido aplicado. Al momento de reservar, Usted nos autoriza de manera escrita y/o verbal a usar su número de tarjeta de crédito para realizar su pago, y confirma expresamente conocer y aceptar los presentes Términos y Condiciones así como la política de privacidad de The Silver XP. Todas las reservaciones están sujetas a disponibilidad al momento de procesar su solicitud. La disponibilidad no puede ser garantizada hasta haber recibido el pago total. Para algunas reservaciones (debidamente identificadas antes de llenar sus detalles de contacto y de la tarjeta de crédito), tenemos que verificar disponibilidad directamente con el departamento de reservaciones del proveedor antes de poder confirmárselas. The Silver XP le pide un máximo de 24 horas para dicha verificación de disponibilidad y confirmación. Con el fin de evitar contratiempos, Usted debe imprimir su cupón correspondiente y presentarlo al momento de requerir su servicio pagado. Si Usted desea cambiar o cancelar su reservación, por favor póngase en contacto a la brevedad posible, con su XPeer asignado, mencionando su número de reservación. The Silver XP le sugiere leer cuidadosamente la cláusula correspondiente a las POLITICAS DE CANCELACION. Cualquier cambio de reservación está sujeto a disponibilidad y re- cotización de tarifas. Para mayor información, Usted deberá contactar a su XPeer asignado, mencionando su número de reservación. Toda reservación confirmada en firme por The Silver XP proporciona un número de control de reservación el cual deberá portar Usted en todo momento.

POLÍTICAS DE PAGO.- El monto correspondiente a su reservación The Silver XP lo cargará inmediatamente a los datos de la tarjeta de crédito que Usted proporcione para tal efecto, siempre y cuando el estatus de su reservación muestre que está confirmada, y aparecerá en su estado de cuenta con la leyenda: “TSXP RESERVATION CENTER”” o con la leyenda equivalente al Proveedor. Para el pago de su reservación, aceptamos Tarjetas de Crédito Visa, Master Card y American Express. Si Usted no cuenta con alguna de estas tarjetas de crédito, puede enviarnos una transferencia bancaria. Para mayor información favor de contactar uno de nuestros XPeer´s. Las tarifas publicadas en nuestro sitio están cotizadas en varios tipos de monedas, las cuales son debidamente especificadas en su momento. Pesos Mexicanos serán cobrados en Pesos Mexicanos. En el caso de cualquier otro tipo de moneda, el monto de la transacción será convertido a Dólares Americanos al tipo de cambio vigente a la fecha de la transacción. Favor de tomar en cuenta que el monto que aparecerá en su recibo de pago de su tarjeta de crédito, puede variar hasta un tres por ciento con motivo de la fluctuación internacional del tipo de cambios de divisas. The Silver XP no es responsable de dicha fluctuación. Usted reconoce haber sido informado de la fluctuación del tipo de cambio y estar de acuerdo con el cargo correspondiente en Dólares Americanos. En caso de requerir factura fiscal, favor de solicitarla a su Xpeer asignado. Cabe mencionar que por razones fiscales las facturas serán elaboradas después de generar el pago o después de haber disfrutado el (los) servicio(s) reservado(s).

Se le informa que existen impuestos y/o cuotas Estatales y Municipales tanto en la República Mexicana como en el Extranjero que podrían ser cobrados directamente por el proveedor final del servicio, The Silver XP no asume ninguna responsabilidad sobre dichos cobros, ni forman parte del precio final de su reservación.

POLÍTICA DE CANCELACIÓN.- Toda solicitud de cancelación debe ser informada por Usted por escrito vía e-mail a su XPeer asignado, mencionando su número de reservación. Para Cancelación de Reservaciones de Hoteles: Al momento de seleccionar el hotel de su preferencia, Usted podrá consultar en los links denominados Política de Cancelación, los términos y condiciones de cancelación aplicables para cada Hotel. No obstante de la información que Usted podrá consultar en dichos links.

A continuación The Silver XP le describe sus políticas generales de cancelación aplicables para la mayoría de los hoteles:

• Las reservaciones canceladas 15 días o más antes de la fecha de llegada están sujetas a un cargo del 10% del total de la cantidad de su reservación.
• Las reservaciones canceladas de 14 a 3 días antes de la fecha de llegada están sujetas a un cargo de 2 noches.
• Las reservaciones canceladas de 2 a 0 días antes de la fecha de llegada, o en caso de no llegar, no serán reembolsadas, salvo casos de fuerza mayor. De igual manera no aplican reembolsos para salidas anticipadas.
• Para las temporadas de Navidad, Año Nuevo y Semana Santa, las políticas de cancelación son diferentes, si desea información al respecto, por favor contacte a uno de nuestros XPeer´s.- En los casos en los que proceda el

reembolso en términos de las presentes políticas de cancelación, la cantidad a reembolsar se verá reflejada en su estado de cuenta dentro de los próximos 5-10 días hábiles dependiendo del Proceso Bancario, principalmente de los plazos de su Banco emisor. Para Cancelación de Reservaciones de Tours y/o  Transportación  Terrestre:  Al  momento  reservar,  las  políticas  de cancelación aplicables para el tour o la transportación terrestre específica, se desplegarán  automáticamente  en  pantalla  para  su  conocimiento.  A continuación  The  Silver  XP  le  describe  sus  políticas  generales  de cancelación, aplicables para la mayoría de los tours y servicios de transportación terrestre:

• Las reservaciones canceladas 3 días o más antes de la fecha del servicio, están sujetas a un cargo del 10% del total de la cantidad de su reservación.
• Las reservaciones canceladas de 2 a 0 días antes de la fecha del servicio, o en caso de no llegar, no serán reembolsadas.

Responsabilidad limitada de The Silver XP:

En virtud de que The Silver XP actúa únicamente como INTERMEDIARIO en la prestación del servicio de transportación, al no ser el prestador directo del servicio, Usted entiende y acepta que una vez que sean solicitados y pagados dichos servicios, si los mismos son cancelados y/o modificados y/o reprogramados por el prestador directo del servicio, por cualquier razón, que puede ser de manera enunciativa más no limitativa: a) deja de realizar sus operaciones de forma habitual;

1. b) inicia algún procedimiento de liquidación o transfiere de forma sustancial sus activos; c) se disuelve o legalmente termina su existencia; d) se inicia sobre él un procedimiento de concurso mercantil; e) se inicia una huelga por sus empleados; f) y/o por cualquier otro motivo, será responsabilidad única y exclusiva de el prestador directo del servicio y no de The Silver Por lo anterior, en el caso de que los servicios en mención no sean proporcionados parcial o totalmente por parte de el prestador directo del servicio, Usted libera a The Silver XP de cualquier responsabilidad o falta  de  cumplimiento,  no  reservándose  ninguna  acción administrativa, civil o penal, ni derecho alguno en contra de The Silver XP, ni a pretender alguna reclamación, compensación, reembolso, indemnización y/o pago de daños y perjuicios. Asimismo, Usted libera a The Silver XP de cualquier responsabilidad que provenga de cualquier siniestro, afectación, daño o cualquier otro análogo que afecte a su pàtrimonio y que pudiera tener el usuario-turista en el uso de los servicios prestados por el prestador de servicios directo.

Una vez que The Silver XP recibe por parte de Usted el importe de los servicios contratados, séan estos de transportación, tours, de hospedaje, en conjunto (paquete) o cualquier otro, The Silver XP cuenta con la autorización inmediata de Usted para emitir, expedir o adquirir, realizar las reservaciones o culquier análoga a su nombre, apegándose y aceptando tanto The Silver XP como Usted las políticas de cancelación, emisión, reservación, venta de boletos y/o cualquier otro de los

prestadores directos de servicios y a las Políticas de Reservación y Cancelación de este Sitio.

PROPIEDAD INDUSTRIAL.- Usted reconoce que la marca “THE SILVER XP” “XPEERS”, “thesilverxp.com”, entre otras, son marcas registradas o en trámite de registro para uso exclusivo de The Silver XP. Y de manera enunciativa más no limitativa las demás marcas, logotipos, nombres comerciales, patentes, modelos de utilidad y métodos comerciales, cartera de clientes, que aparecen ó funcionan en este Sitio, constituyen derechos de Propiedad Industrial que se encuentran registrados o en proceso de registro, son propiedad exclusiva de The Silver XP, de sus afiliadas, ó terceras partes contratantes, y fueron proporcionadas para el uso del Sitio, por tal razón The Silver XP cuenta con las autorizaciones y/o licencia de uso respectiva y por tanto Usted no puede copiar, reproducir, volver a publicar, cargar, publicar, modificar, transmitir o distribuir dichos derechos ni el contenido de este Sitio, sin tener la autorización previa y por escrito de The Silver XP, excepto, en los casos (a) en que Usted descargue para ver e imprimir el material que se encuentra contenido en este Sitio ó (b) descargue o imprima el material que le sea enviado a su correo electrónico por parte de The Silver XP, en cuyas situaciones, Usted única y exclusivamente podrá utilizarlo para su uso personal, debiendo incluir siempre la leyenda “© The Silver XP, S.A. En razón de lo anterior, nada de lo contenido en este Sitio incluyendo sus derechos protegidos por la Ley de Propiedad Industrial aplicable, por las Leyes y Tratados Internacionales, podrá ser considerado por Usted como una licencia o derecho a usar cualquiera de las Marcas Comerciales, o demás derechos de Propiedad Industrial sin el previo consentimiento por escrito de The Silver XP, o en su caso de los titulares de tales derechos. Y se le prohíbe utilizarlas en cualquier otra aplicación que no sea permitida por The Silver XP o cualquier otro uso comercial. Usted acuerda en no alterar la Propiedad Industrial de The Silver XP en modo alguno, ni se permitirá la acción que de cualquier manera que pueda menoscabar, denigrar o disminuir los derechos de Propiedad Industrial de The Silver XP. Usted se compromete a no utilizar las marcas o nombres comerciales de The Silver XP como nombres de dominio ni registrarlos como parte de un nombre de dominio, o bien su colocación como parte de Publicidad en Internet sin previo consentimiento por escrito de The Silver XP. The Silver XP se reserva el derecho de vigilar la calidad del uso de su Propiedad Industrial, además, notificará a Usted de inmediato por escrito en el caso de percatarse de la existencia de cualquier violación de su Propiedad Industrial. Cualquier uso inapropiado del contenido y de la Propiedad Industrial de este Sitio es susceptible de violación de las Leyes de Propiedad Industrial, Mexicanas y Extranjeras, de Tratados Internacionales así como derechos consignados en el Código Civil, Penal y de Comercio. Si Usted incurriera en algún uso inapropiado del contenido y Propiedad Industrial de este Sitio, The Silver XP tendrá el derecho de requerirle (a) que deje de utilizar el contenido que The Silver XP considere vulnera sus derechos de Propiedad Industria. (I) CUALQUIER USO DE ESTE SITIO O DEL CONTENIDO QUE AQUÍ SE ENCUENTRE, (II) CUALQUIER FALLA O DEMORA (INCLUYENDO, SIN QUE HAYA LIMITE, EL USO DE, O LA IMPOSIBILIDAD DE USAR CUALQUIER COMPONENTE DE ESTE SITIO PARA LOS SERVICIOS DE RESERVACION O CONTRATACION), O (III) EL FUNCIONAMIENTO O NO FUNCIONAMIENTO DEL PROVEEDOR,  INCLUIDO,  PERO  SIN  ESTAR  LIMITADO  A,  EL  NO FUNCIONAMIENTO RESULTADO DE LA BANCARROTA, REORGANIZACION, QUIEBRA,  CONCURSO  MERCANTIL,  DECLARACION  DE  INSOLVENCIA, DISOLUCION O LIQUIDACION, HUELGA, PARO DE LABORES, SUSPENSIÓN DE  ACTIVIDADES  POR  DECISIÓN  DE  LOS  TRABAJADORES  DE  LOS PROVEEDORES, O POR CUALQUIER OTRO SIMILAR, YA QUE USTED COMPRENDE QUE THE SILVER XP ES ÚNICAMENTE INTERMEDIARIO EN LA PRESTACIÓN DE LOS SERVICIOS TURÍSTICOS OFERTADOS EN EL SITIO Y COMPRENDE QUE EN LA MAYORÍA DE LOS CASOS NO PUEDE CONTROLAR EL DESTINO DE LOS PAGOS QUE USTED HAYA REALIZADO Y MÁS AÚN SI YA  FUERON  UTILIZADOS,  EN  SU  CASO,  POR  LOS  PROVEEDORES,

INCLUYENDO  HOTELES,  AEROLÍNEAS,  EMPRESAS  DE  TRANSPORTE TERRESTRE, ETC.

RESPONSABILIDAD.- Usted deberá responder de los daños que genere a The Silver XP, que resulten de cualquier mal uso o uso incorrecto que pudiera hacer del Sitio, o sobre cualquier operación fraudulenta o con fines contrarios a los servicios prestados en el sitio o aquellos que vayan en contra de las leyes y reglamentos vigentes y aplicables.

enlace a diversas páginas sociales, entre ellas, las páginas de Facebook con nombre de usuario: The Silver XP , la página de INSTAGRAM con nombre de usuario: the_silver_xp, página de twitter con nombre de usuario: @thesilverxp1 y You Tube con usuario The Silver XP , cuentas administradas por The Silver XP; Usted reconoce que dichas páginas son exclusivamente para uso informativo y difusión social de The Silver XP, y The Silver XP no será responsable de manera enunciativa más no limitativa por el contenido, información, publicación de terceros, comentarios, fotografías, videos, contenido de hastags, ni cualquier otro material fuera del alcance de la administración directa de The Silver XP, ni por el material que compartido en dichos sitios sociales por Usted o cualquier tercero y fuera de la administración de The Silver XP pueda violar los derechos de propiedad industrial o derechos de autor. Usted es responsable del uso que le pueda dar a dichos sitios, y Usted libera de toda responsabilidad a The Silver XP por cualquier uso incorrecto o mal intencionado que pudiera hacer de los mismos, o por publicaciones, información, comentarios, y material diverso que pudiera resultar ofensivo, insidioso, erróneo, pornográfico o que pudiera incitar a la violencia, rebelión, huelga, o cualquier actividad no permitida por la ley y las buenas costumbres.

CLIMA.- Este Sitio podrá proporcionarle a Usted el servicio de información y actualización del clima, mismo que podrá publicarse única y exclusivamente para fines informativos; Usted deslinda a The Silver XP y The Silver XP no será responsable sobre cualquier inconsistencia, inexactitud o información publicada dentro de su servicio del Clima, The Silver XP no se hace responsable por cualquier cambio en las condiciones climáticas, ello por encontrarse fuera del control absoluto de The Silver XP, por tanto Usted reconoce y libera de toda responsabilidad a The Silver XP de manera limitativa, más no enunciativa, sobre cualquier, reclamación, reembolso, queja, compensación, crédito, cambio, cancelación, inconveniencias, molestias, accidente, heridas, enfermedades, pérdidas físicas o materiales, daños, detrimento o afectación en su persona o en su patrimonio, muerte y todas aquellas

derivadas de las condiciones climáticas de cualquiera de los destinos ofertados por The Silver XP.

MAPAS.- Este Sitio podrá proporcionarle a Usted el enlace exclusivamente para fines informativos de Google Maps ©, respecto de la ubicación de diversos servicios proporcionados por The Silver XP; Usted reconoce que los mapas que podrán publicarse en el Sitio, así como la ubicación de tales servicios, son únicamente para fines de ubicación y localización aproximada, no obstante, Usted reconoce y conviene que al hacer uso de los mapas, Usted se sujeta a los términos y condiciones de uso que establece Google Maps ©, por lo que Usted libera a The Silver XP de cualquier responsabilidad derivada de cualquier inconsistencia respecto a la ubicación o direcciones mostradas en los mapas, libera a The Silver XP sobre cualquier desorientación, o cualquier pérdida de ubicación que pudiera sufrir derivada del uso de los mapas y libera a The Silver XP de manera enunciativa mas no limitativa sobre cualquier cambio, reembolso, queja, cancelación, recargos, no show, reclamo, crédito, compensación y cualquier otro que pudiera derivar de las inconsistencias o uso inapropiado de los mapas publicados en este Sitio y propiedad exclusiva de Google Maps ©.

INFORMACIÓN VERDADERA.- Usted reconoce y acepta su total obligación y responsabilidad de proporcionar datos veraces y correctos sobre las edades, sexo, nombres o apellidos tanto de Usted como de los demás usuarios-turistas que lo acompañen o que lo comisionen para hacer uso de éste Sitio, así como de los datos e información completa para la formación del itinerario y la reservación de servicios terrestres y marítimos (hoteles, visitas, autos de alquiler, restaurantes, cruceros, etc) liberando a THE SILVER XP de cualquier responsabilidad por cambios de itinerario generados por datos mal proporcionados, o por cualquier error en los datos proporcionados por Usted para la emisión, compra o reservación de los servicios otorgados por el prestador de servicio directo como puede ser el caso de edades, sexo, nombres, apellidos, fechas, formas de pago, rutas, líneas aéreas, horarios, clases, categorías, condiciones especiales, etcétera, apegándose en su caso a las cláusulas de cancelación para dichos servicios expresadas en estos Términos y Condiciones.

RESPETO DE LOS REGLAMENTOS Y CONDICIONES DE LOS SERVICIOS.-

Usted se compromete a apegarse y a respetar los reglamentos y condiciones de servicio establecidas por cada uno de los Proveedores y prestadores directos de servicios contratados por Usted a través de la intermediación de THE SILVER XP, por lo que THE SILVER XP debe hacer de su conocimiento las que sean más importantes, no obstante el Proveedor podrá hacer de su conocimiento nuevas o adicionales condiciones de servicio sobre las cuales The Silver XP no tiene responsabilidad alguna y en consecuencia declina cualquier responsabilidad que pudiera derivar por su incumplimiento. Así mismo, Usted deberá por medios propios proveerse de los pasaportes o documentos de migración requeridos por las autoridades de los Estados Unidos Mexicanos y de los países de destino ó de transito,  tales  como  visas,  permisos  sanitarios,  vacunas  y  todos  aquellos documentos  requeridos  por las  autoridades  Aduaneras,  Aéreas,  Marítimas, Aeroportuarias, Federales, Estatales, Municipales etcétera, que resulten necesarias

para realizar su viaje, liberando a The Silver XP sobre cualquier problema que llegare a surgir con dichas autoridades, así como de la pérdida de boletos de avión, transportación aérea o noches de hotel con motivo de dichas omisiones que en ningún caso podrán ser imputadas a The Silver XP por ser de responsabilidad exclusiva de Usted.

En caso de reservaciones hoteleras, tours o transportación, Usted se compromete a firmar a la llegada al establecimiento reservado, el contrato del servicio, la tarjeta de  registro  o  documentación  correspondiente  proporcionado  por  dicho establecimiento.

DEL ORIGEN DE LOS RECURSOS: El usuario-turista declara que los recursos con los que pagará cualquier tipo de servicio, reservación o cualquier otro producto relacionado con el presente instrumento, son de origen lícito.

ANTICIPACION O LIQUIDACION DEL IMPORTE.- Ambas partes convienen en que el pago de anticipos o liquidación del importe de los servicios objeto de los presentes Términos y Condiciones por parte de Usted, así como el uso de cupones, boletos, cortesías, o cualquier otro documento expedido en su favor, implica de su parte la aceptación total de estos Términos y Condiciones.

CONVENIOS ADICIONALES CON PROVEEDORES.- The Silver XP queda

relevada de cualquier responsabilidad derivada de convenios adicionales y fuera de la intermediación con The Silver XP que se hayan celebrado entre Usted y demás Proveedores prestadores directos de los servicios, como son transportistas aéreos y terrestres, navieras, cruceros, hoteles, arrendadoras de autos, etcétera.

SERVICIOS POR O PARA TERCERAS PERSONAS.- En el caso de que Usted contrate los servicios de The Silver XP a través del Sitio, en algún de nuestros establecimientos, por cuenta de diversa agencia de viajes o de cualquier tercero, o bien los contrate Usted a favor de terceras personas, Usted está de acuerdo que todos los sujetos antes mencionados se sujetarán invariablemente a los presentes Términos y Condiciones. Para el caso de que Usted contrate los servicios de The Silver XP por cuenta de diversa agencia de viajes, o cualquier tercero, fungiendo éstos como intermediarios, The Silver XP se deslinda de cualquier responsabilidad o problema generado por el incumplimiento de la intermediaria o agencia de viajes y en el mismo sentido por datos mal proporcionados por la intermediaria o agencia de viajes para la reservación de cualquier servicio, o bien, por la negligencia en que pudiera incurrir dicha intermediaria al omitir información al usuario-turista o a Usted sobre los procedimientos de contratación, pago y cancelación de los servicios que se adquieren.

DESLINDE DE RESPONSABILIDADES.- The Silver XP como Agencia de Viajes por internet, presta servicios en calidad de agente de reservaciones intermediaria entre Usted y el Proveedor o Proveedores directos de los servicios turísticos promocionados en este Sitio. The Silver XP establece negociaciones comerciales dentro de sus propios estándares de calidad y servicio, tales como, pero no limitados a: hospedaje en hoteles, transportación terrestre y otras actividades turísticas afines como tours y excursiones, eligiendo sólo a los proveedores más calificados y de

mayor prestigio del mercado. Ahora bien, toda vez que el carácter jurídico de The Silver XP es el de fungir única y exclusivamente como INTERMEDIARIA y no como proveedora directa de los servicios turísticos, The Silver XP no asume ni asumirá ninguna responsabilidad generada de relación alguna ante Usted y los Prestadores Finales de Servicios y a su vez Usted libera a The Silver XP sobre cualquier responsabilidad ante cualquier falla o falta de cumplimiento por parte del Proveedor o Proveedores directos de los servicios turísticos, incluyendo sin limitación alguna cualquier falla o cumplimiento por parte de las aerolíneas, hoteles, proveedores de hospedaje temporal, navieras y toda clase de embarcaciones, proveedores de deportes acuáticos, agencias de renta de autos, agencias de transportación, operadores de tours, instructores de buceo, instructores de esnórquel, instructores de golf, instructores de nado con delfines, instructores de pesca, proveedores de deportes de aventura y deportes extremos, parques acuáticos, parques ecológicos, y en general sobre cualquier falla o falta de cumplimiento por parte de todos aquellos servicios turísticos que sean proporcionados de manera directa por uno o varios Proveedores y no de manera directa por The Silver XP; Sin embargo The Silver XP, podrá a su libre discreción proporcionarle datos de contacto y/o domicilio del proveedor a efecto de que Usted ejerza la reclamación respectiva o vía de reclamación que Usted considere necesaria. The Silver XP como Agencia de Viajes y agente INTERMEDIARIA de reservaciones, no ofrece, ni ofrecerá ninguna garantía sobre los servicios proporcionados de manera directa por los Proveedores, ni garantiza la posición financiera de los mismos o cualquier reembolso a Usted ocasionado por cualquier pérdida experimentada como resultado de la condición financiera de dicho Proveedor, incluyendo sin limitación alguna, la insolvencia económica, o Concurso Mercantil en que se llegare a declarar dicho Proveedor. En el evento en que el Proveedor falle en el cumplimiento de alguno de sus servicios, por los cuales el pago Usted ya ha realizado, el solo recurso del reembolso deberá tramitarse directamente ante el Proveedor que falló en la prestación de sus servicios, o pueda solicitar la cobertura del seguro en el caso de ser aplicable o ante cualquier otra tercera parte, a menos que el anterior fallo sea ocasionado de manera directa por The Silver XP. The Silver XP, no asume responsabilidad ante Usted y Usted libera de toda responsabilidad a The Silver XP por actos, omisiones o cualquier tipo de queja o insatisfacción derivados de los servicios proporcionados por los proveedores directos de servicios en el Sitio anunciados, en virtud de que The Silver XP no tiene control alguno o relación legal sobre su personal, equipo, operación, publicidad o bienes. En aquellas situaciones en que el Proveedor falle en la prestación de sus servicios Usted podrá intentar cualquier recurso permitido por las leyes aplicables en contra del Proveedor. The Silver XP le garantiza que cuenta con altos estándares de servicio y tomará un cuidado especial en la selección de los Proveedores para evitar en todo momento la falla de los mismos.

Asimismo The Silver XP no será responsable y Usted libera de toda responsabilidad a The Silver XP respecto de:

1. La veracidad de las fotografías mostradas en su Sitio ya que las mismas son solamente representativas y no garantizan que a su llegada, todo sea exactamente igual como en ellas se aprecia y en el Sitio describe; ya que las

mismas son proporcionadas por los propios proveedores directos del servicio, por la que su veracidad es responsabilidad única y exclusiva de los proveedores y cualquier reclamación sobre supuesta publicidad engañosa Usted reconoce que deberá realizarla directamente a los proveedores por no ser The Silver XP responsable de dichas imágenes con pleno conocimiento de usted desde el momento en que contrata su servicio turístico.

1. La categoría de estrellas asignada a los hoteles y servicios, ya que están basadas en la interpretación de The Silver XP y de los Proveedores Directos de Servicios y pueden diferir de las categorías reportadas en otros lugares;
2. Las descripciones de los servicios de viaje son actualizadas por The Silver XP a su mejor conocimiento, pero no garantizan que todo será exactamente igual a su llegada;
3. Cualquier tipo de falla por parte de Usted en obtener la documentación requerida para su viaje tal como, pero no limitada a, pasaportes, visas, vacunas, permisos, certificados etc.
4. Cualquier tipo de falla por parte de Usted para seguir las instrucciones de viaje incluyendo, pero no limitado a, horarios de salida de aeropuerto, hora y fecha de entrada y salida en hoteles, políticas de canje de cupones etcétera;
5. Por falta  de  condiciones  financieras  por  parte  del  Proveedor  para proporcionar el servicio, en el caso que el proveedor del servicio final se declare en quiebra o bancarrota y/o concurso mercantil en huelga, suspensión temporal o definitiva de actividades conforme a la legislación de México o de los países en donde se encuentre el prestados del servicios y que por dichas causas o cualquier otra similar tenga que dejar de prestar el servicio, Usted está de acuerdo en que tendrá que solicitar la devolución de la cantidad pagada directamente al proveedor, toda vez que, el proveedor final del servicio es quien tiene en su poder la cantidad pagada por
6. Respecto a los términos y condiciones y/o políticas de los Proveedores directos de The Silver XP no asumirá responsabilidad alguna y Usted libera de toda responsabilidad a The Silver XP, así como de toda reclamación, costo, gasto o pérdida que Usted pudiera sufrir incluyendo cualquier herida personal o de terceras personas, accidentes o deceso, daños a pertenencias personales, pérdida de diversión, enojo, desilusión, angustia o frustración, ya sea mental o física, siempre que sean resultado de:
   • Cualquier falla o falta por parte del Proveedor directo al proporcionar el servicio.
   • Cualquier falla o falta por parte de Usted al momento de disfrutar de los servicios contratados.
   • Cualquier falla o falta de usted al observar o cumplir los términos y condiciones, políticas, instrucciones, recomendaciones, medias de seguridad, etc de los Proveedores finales del servicio.
   • Casos de fuerza mayor o casos fortuitos como lo son: huelgas, atrasos, terremotos, conflictos bélicos, huracanes, nevadas, y en general cualquier otro evento legal o de la naturaleza que sea impredecible y que no le sea imputables a The Silver XP.
   • Actos u omisiones de cualquiera otra persona que no sea The Silver XP

• Enfermedad, robo, disputas laborales, fallas mecánicas, cuarentena, acciones gubernamentales, clima, o cualquier otra causa ajena al control directo de The Silver XP
• Malos entendidos por parte de Usted respecto de los términos y condiciones en que se prestará el servicio, ya que Usted entiende que los únicos que regirán son los presentes y no cualquier otro que Usted crea haber recibido de manera verbal o telefónica por cualquier persona, ya que los que regirán serán siempre los que usted recibió por escrito y estos al estar vigentes al momento de realizar su reservación.
• Ante la insistencia de Usted para realizar cualquier tipo de viaje, actividad turística, tomar un tour, excursión, tomar cualquier tipo de transportación aérea, terrestre, marítima y de cualquier tipo, bajo condiciones precarias de salud o que no sean óptimas para el desarrollo de tales actividades, así como el desarrollo por Usted de cualquier tipo de deportes extremos o actividades que puedan implicar algún peligro y que fueron realizados bajo su entero conocimiento, o cuando padezca algún tipo de enfermedad, condición médica, incapacidad, algún tipo de alergia, se encuentre bajo medicación o prescripción médica, indicaciones de reposo y/o todas aquellas condiciones médicas que bajo su propio riesgo fueron omitidas y que pudieran resultar en un deterioro a su salud al momento de realizar dichas actividades bajo consciencia de causa, bajo dichas ocasiones siempre se considerarán fueron realizadas bajo su propio riesgo, liberando Usted a The Silver XP respecto de cualquier denuncia, demanda, queja,  inconformidad,  recompensa,  indemnización, compensación, reclamación por daños directos, indirectos, punitivos, cortesía, , derivados de cualquier incidente ocasionado durante el desarrollo de cualquier servicio o actividad y cualquier evento futuro derivado del incidente inicial por cualquiera de estas causas.
• Cualquier otro evento que no se encuentre bajo el control directo de The Silver Cualquier reclamación o notificación por escrito en contra de The Silver XP, deberá ser recibida a más tardar con catorce

(14) días después del regreso de su viaje; The Silver XP se reserva el derecho de rechazar o realizar una operación comercial con algún Usuario- Turista en cualquier momento; The Silver XP se reserva el derecho de cancelar o cambiar los servicios de viaje a nuestra discreción, pero se tratará de sustituirlos con servicios comparables; Usted será responsable de verificar que el Proveedor final cuente con servicios especiales como puede ser acceso, comodidades y servicios para personas con capacidades diferentes, físicas o de cualquier otro tipo, lo cual se le sugiere lo haga previamente a la realización de su reservación. Usted será responsable de leer y de sujetarse a los términos y condiciones y/o políticas de los Proveedores finales de servicios.

El reembolso total no será procedente en situaciones en las que el viaje tenga que ser cancelado, interrumpido y/o pospuesto por The Silver XP por razones que estén fuera de su control (causas de fuerza mayor, tales como, pero no limitadas a, clima, huracán, terremotos, actos de terrorismo, huelgas, pandemias, solicitud de quiebra o concurso mercantil, suspensión de actividades, etc.) y en los que las obligaciones contractuales de The Silver XP con sus proveedores no le permitan obtener reembolso de la suma pagada o a ser pagada al Proveedor por cuenta del cliente. En cualquier caso, a discreción de The Silver XP , se podrá retener un 10% del total de la cantidad pagada por la reservación como gasto administrativo. A pesar de la estrecha comunicación establecida por The Silver XP con los Proveedores aquí anunciados, existe la posibilidad de que la vigencia de algunos precios haya expirado o provenga de información erróneamente o imprecisamente proporcionada por dichos Proveedores con la que nuestra base de datos es alimentada. No obstante esto, The Silver XP toma la precaución de verificar las tarifas que aplican con cada reservación. En caso de que el precio correcto sea menor a la cantidad cotizada, The Silver XP aplicará el monto menor. En caso de que el precio correcto sea mayor a la cantidad cotizada, su XPeer asignado se pondrá oportunamente en contacto con Usted, informándole la cantidad correcta o bien registrando la cancelación de la reservación a petición suya por no estar de acuerdo con el incremento  en  precio,  deslindando  expresamente  a  The  Silver  XP  y sus Proveedores  de  cualquier  responsabilidad  o  pago  de  indemnización  por inconvenientes causados por dicha cancelación. En el caso de que los servicios contratados no pudieran ser proporcionados parcial o totalmente por parte del Proveedor, The Silver XP solo podrá en determinadas ocasiones gestionar por cuenta de Usted el reembolso del importe que proceda, quedando relevada The Silver XP de cualquier responsabilidad o compromiso mayor en los casos en que el reembolso por la cantidad total o restante no sea reembolsada por el Proveedor.

En casos de que por algún error o manipulación por Usted del sistema de The Silver XP se obtenga una cantidad ilógicamente menor al valor comercial del servicio ofertado, a menos que se ofrezca expresamente como una oferta extraordinaria o como promoción por ser cliente frecuente, The Silver XP podrá notificar al cliente- turista el precio real y verdadero antes de la prestación del servicio, a efecto de que el cliente decida si desea conservar su reservación y en caso de no ser así, acepta que las cantidades que haya pagado, le sean reembolsadas en el mismo método de pago que haya realizado, sin responsabilidad para The Silver XP.

TERMINACIÓN.- The Silver XP podrá dar por terminado estos Términos y Condiciones y/o cualquiera de sus servicios en cualquier momento sin necesidad de avisar o notificar dicha terminación, por cualquier causa o motivo, incluyendo por cualquier uso inapropiado de este sitio o su incumplimiento con estos Términos y Condiciones. No obstante tal terminación no afectará ningún derecho u obligación contraída por The Silver XP ante Usted una vez confirmada una reservación.

CESIÓN.-  Usted  no  podrá  ceder,  subcontratar,  o  delegar sus  derechos, obligaciones o deberes aquí contraídos.

DIVISIBILIDAD.- Estos Términos y Condiciones continuarán siendo divisibles. En caso de que cualquier término o Condición sea considerada prohibida o inejecutable, tal disposición no obstante será obligatoria y tal determinación no afectará la validez y obligatoriedad de cualquiera otra disposición restante.

TITULOS.- Los títulos usados en los Términos y Condiciones son sólo utilizados para su conveniencia y no limitarán o afectarán de otra manera el contenido de los Términos y Condiciones aquí establecidos.

ACUERDO TOTAL.- Los presentes Términos y Condiciones, que aquí se incluyen, o a los cuales se haga referencia, constituyen el acuerdo total y completo entre las partes en relación con el objeto aquí establecido, y sustituye cualquier acuerdo o contrato anterior efectuado entre las partes (ya sea oral o escrito) que esté relacionado con el mismo objeto, y no será enmendado o modificado excepto si se hace por escrito o haciendo que tales enmiendas o modificaciones estén disponibles en este sitio.

LEGISLACIÓN APLICABLE.- Estos Términos y Condiciones se regirán por las leyes del estado Quintana Roo. Usted manifiesta que conoce los alcances del presente Contrato, cuyos Términos y Condiciones son la expresión fiel de su voluntad y se someten para el caso de incumplimiento o interpretación a la competencia de la Procuraduría Federal del Consumidor, en la vía administrativa, como instancia conciliatoria, para resolver las diferencias que pudieran suscitarse y en caso de subsistir las mismas Usted está de acuerdo en someterse a la competencia de las Leyes y Tribunales de Cancún, Quintana Roo, México, bajo su jurisdicción exclusiva, renunciando a su vez a cualquier otra jurisdicción que en razón de sus domicilios presentes o futuros o por la ubicación de sus bienes o por su nacionalidad pudiera corresponderle. En la medida que lo permita la ley de aplicación, ninguna queja, reclamo o causa de acción que esté relacionado con su acceso o uso de este Sitio deberá presentarse posterior al término transcurrido de un (1) año siguiente a la fecha en que tal queja, reclamo o acción se haya presentado o la compra haya sido completada.

DEFINITIONS.- For all purposes of the Terms and Conditions established herein, the following definitions shall be understood:

TRAVEL AGENCY.- Company that carries out  the commercialization of services through technological platforms, islands in shopping centers or plazas, as well as conventions and / or tourism expos in different places, which hire and / or act as an intermediary through their reservation services, for the benefit of a User-Tourist, regarding the tourist services provided directly by the Supplier. (Hereinafter referred to hereinafter as ” The Silver XP”).

USER-TOURIST.-  Person  who  travels  temporarily  and  /  or  who  uses  the https://thesilverxp.mx site, in order to make use of the intermediation and the reservation engine of The Silver XP and with the ultimate purpose of enjoying any of the tourist services provided directly by the Provider. (Hereinafter referred to hereinafter as ” You”).

PROVIDER.- Natural or legal person who directly provides tourist services to the User- Tourist, contracted, reserved or acquired by the latter through the intermediation and booking engine of The Silver XP site.

XPEER.- Personnel specialized in attention to the  User-Tourist who has the functions, including but not limited to, make reservations in restaurants, tour, transportation, travel advice, recommendations of tourist activities and events within different destinations, promotion of tourist services, orientation of medical services, and any other need.

STATEMENTS.- You declare under protest of telling the truth, appearing in your own and personal right and / or through your legal representative, that you are a natural or legal person, of legal age, skillful, capable and with sufficient means or with economic capacity to be bound under these Terms and Conditions, as well as with interest in acquiring the intermediation and reservation services specified herein, and that for this you resort to The Silver XP in order to function as a mere intermediary between you and the Suppliers direct

providers of tourist services.

You declare under protest of truth, that you acknowledge that the services provided by The Silver XP and its Site, consist SOLELY AND EXCLUSIVELY IN THE INTERMEDIATION BETWEEN YOU AND THE DIRECT PROVIDER OF THE SERVICES. The Silver XP S.A de C.V.; declares (a)

to be a commercial company duly constituted in accordance with Mexican laws. (b) That it has authorization from the Ministry of Tourism to provide Travel Agency service, likewise it is registered with the Tax authorities with the Federal Taxpayers Registry number TSX190427HI7. (c) That its address is located at Calle Caimito, Mz 13, Lote 18, SM 25, Cancún, Quintana Roo, C.P. 77509. (d) That its corporate purpose consists of the faculty to: Act as an intermediary for the reservation of spaces in the means of transport and issue the corresponding tickets on behalf of the carriers and in favor of tourists; (e) serve as an intermediary between tourists and transport service providers of any kind, in the terms indicated by the Laws and Regulations;  Booking rooms and other related services for tourists in hotels and lodging establishments; providing tourists with reservation services for tourist attraction sites; acting as an intermediary between other providers of tourist services and other travel agencies; providing tourist information services and disseminating such propaganda material that is freely distributed. (f) Serve as an intermediary between other providers of tourist services (including, but not limited to, hotels, entertainment centers, excursions, guided tours and / or rental of all types of vehicles) and other travel agencies (g) That for the purposes of these Terms and Conditions, only acts as an INTERMEDIARY between you and the Providers of said tourist services, and that for this purpose, it has the technical and administrative capacity, as well as the material and human elements necessary to reserve on behalf of and at your request the services referred to in these Terms and Conditions. (h) That based on the foregoing Statements, you accept these Terms and Conditions.

OBJECT.- The object consists of the INTERMEDIATION that will exist between The Silver XP, You and the Suppliers, where The Silver XP for the purposes of these Terms and Conditions, will act solely and exclusively as an INTERMEDIARY, providing you through your Site in an enunciative but not limiting way, the ground transportation reservation service, and aerial; reservation in hotels and lodging establishments; reservation of tourist attraction sites; booking travel packages; among others, Thus, once the reservations are confirmed by The Silver XP containing the tourist services chosen by You (according to your availability), the provision of the intermediation service by The Silver XP will be concluded, since said tourist services will be provided to You by the Suppliers directly.

This Site and its content referred to therein, but not limited to: texts, paragraphs, statements, specific combination of words, letters or phonetic elements, graphics, button icons, trademarks, logos, graphic design works, photographs, commercial notices, patents, commercial method, specific combination of colors and shapes, editorial material, printed formats, search formats, digital downloads, compilations of data, source code, software, etc. are the exclusive property of The Silver XP or have all the Licenses and Authorizations for such use,

RESERVATION, PAYMENT AND CANCELLATION POLICIES

RESERVATION POLICIES.- The rates shown on the website are only valid at the time of quotation. The rates will apply for their respective charge, only in case of booking the

desired service, otherwise these rates may vary. A reservation is considered completed when you have a confirmation number and the corresponding charge has been applied. At the time of booking, you authorize us in writing and / or verbally to use your credit card number to make your payment, and expressly confirm to know and accept these Terms and Conditions as well as the privacy policy of The Silver XP. All reservations are subject to availability at the time of processing your request. Availability cannot be guaranteed until full payment has been received. For some reservations (properly identified before filling out your contact and credit card details), we need to check availability directly with the supplier’s reservations department before we can confirm them to you. The Silver XP asks for a maximum of 24 hours for such availability check and confirmation. In order to avoid setbacks, you must print your corresponding coupon and present it at the time of requesting your paid service. If you wish to change or cancel your reservation, please contact your assigned XPeer as soon as possible , mentioning your reservation number. The Silver XP suggests that you carefully read the clause corresponding to the CANCELLATION POLICIES. Any reservation change is subject to availability and re-quotation of rates. For more information, you should contact your assigned XPeer, mentioning your reservation number. Every reservation confirmed by The Silver XP provides a reservation control number which you must carry at all times.

PAYMENT POLICIES.- The amount corresponding to your reservation The Silver XP will be charged immediately to the credit card information you provide for this purpose, provided that the status of your reservation shows that it is confirmed, and will appear on your statement with the legend: “TSXP RESERVATION CENTER” or with the legend equivalent to the Provider. For the payment of your reservation, we accept Visa, Master Card and American Express Credit Cards. If you do not have any of these credit cards, you can send us a bank transfer. For more information please contact one of our XPeer’s. The rates published on our site are quoted in several types of currencies, which are duly specified at the time. Mexican Pesos will be charged in Mexican Pesos. In the case of any other currency, the transaction amount will be converted to U.S. Dollars at the exchange rate in effect on the date of the transaction. CANCELLATION POLICY.- Any cancellation request must be informed by you in writing via e- mail to your assigned XPeer , mentioning your reservation number. For Cancellation of Hotel Reservations: When selecting the hotel of your preference, you can consult in the links

called Cancellation Policy, the cancellation terms and conditions applicable for each Hotel. Notwithstanding the information that you can consult in these links.

The Silver XP describes below its general cancellation policies applicable to most hotels:

• Reservations canceled 15 days or more prior to arrival date are subject to a charge of 10% of the total amount of your reservation.
• Reservations cancelled 14-3 days prior to arrival are subject to a 2-night charge.
• Reservations canceled 2 to 0 days before the arrival date, or in case of non-arrival, will not be refunded, except in cases of force Likewise, refunds do not apply for early departures.

The Silver XP Limited Liability:

In case of hotel reservations, tours or transportation, you agree to sign upon arrival at the reserved establishment, the service contract, the registration card or corresponding documentation provided by said establishment.

OF THE ORIGIN OF THE RESOURCES: The user-tourist declares that the resources with which he will pay any type of service, reservation or any other product related to this instrument, are of lawful origin.

ANTICIPATION OR SETTLEMENT OF THE AMOUNT.- Both parties agree that the payment of advances or settlement of the amount of the services subject to these Terms and Conditions by you, as well as the use of coupons, tickets, courtesies, or any other document issued in your favor, implies on your part the total acceptance of these Terms and Conditions.

ADDITIONAL AGREEMENTS WITH SUPPLIERS.- The Silver XP is relieved of any liability arising from additional agreements and outside the intermediation with The Silver XP that have been concluded between you and other Suppliers direct providers of services, such as air and land carriers, shipping companies, cruises, hotels, car rental companies, etc. ether.

In the event that you hire the services of The Silver XP on behalf of various travel agencies, or any third party, acting as intermediaries, The Silver XP disclaims any responsibility or problem generated by the breach of the intermediary or travel agency and in the same sense by data poorly provided by the intermediary or travel agency for the reservation of any service.

, or due to the negligence that said intermediary may incur by omitting information to the

user-tourist or to you about the procedures for contracting, payment and cancellation of the services purchased.

DISCLAIMER.- The Silver XP as an  Internet Travel Agency, provides services as an intermediary reservation agent between you and the Supplier or Direct Suppliers of the tourist services promoted on this Site. The Silver XP establishes commercial negotiations within its own standards of quality and service, such as, but not limited to: hotel accommodation, ground transportation and other related tourist activities such as tours and excursions, choosing only the most qualified and prestigious suppliers in the market. However, since the legal nature of The Silver XP is to serve solely and exclusively as an INTERMEDIARY and not as a direct provider of tourist services,  The Silver XP does not assume or assume any responsibility generated from any relationship with you and the Final Service Providers and in turn you release The Silver XP on any responsibility for any failure or non-compliance by the Supplier or Direct Suppliers of tourist services, including without limitation any failure or compliance by airlines, hotels, temporary accommodation providers, shipping companies and all kinds of boats, water sports providers, car rental agencies, transportation agencies, tour operators, diving instructors, snorkeling instructors, golf instructors, swim with dolphin instructors, fishing instructors, adventure sports and extreme sports providers, water parks, ecological parks, and in general about any failure or lack of compliance by all those tourist services that are provided directly by one or more Suppliers and not directly by The Silver XP ; However, The Silver XP, may at its discretion provide you with contact information and / or address of the supplier in order for you to exercise the respective claim or claim route that you consider necessary. The Silver XP as a Travel Agency and INTERMEDIARY agent of reservations, does not offer, nor will it offer any guarantee on the services provided directly by the Suppliers, nor does it guarantee the financial position of the same or any reimbursement to You caused by any loss experienced as a result of the financial condition of said Supplier, including without limitation,  the economic insolvency, or Commercial Bankruptcy in which said Supplier will be declared. In the event that the Supplier fails to comply with any of its services, for which payment You have already made, the sole remedy of reimbursement must be processed directly with the Provider who failed to provide its services, or may request insurance coverage if applicable or before any other third party, unless the above failure is directly caused by The Silver XP. The Silver XP, assumes no responsibility to You and You release  The Silver XP from all liability for acts, omissions or any type of complaint or dissatisfaction arising from the services provided by the direct service providers on the Site advertised, by virtue of which The Silver XP  It has no control or legal relationship over its personnel, equipment, operation, advertising or property. In those situations where the Provider fails to provide its services You may seek any remedy permitted by applicable laws against the Provider. The Silver XP guarantees that it has high standards of service and will take special care in the selection of Suppliers to avoid their failure at all times.

Likewise, The Silver XP shall not be liable and You release The Silver XP from all liability for:

1. The veracity of the photographs shown on your Site since they are only representative and do not guarantee that upon arrival, everything will be exactly the

same as they are seen and described on the Site; since they are provided by the direct suppliers of the service, so their veracity is the sole and exclusive responsibility of the suppliers and any claim about alleged misleading advertising You acknowledge that you must make it directly to the suppliers because The Silver XP is not responsible for said images with full knowledge of you from the moment you hire your tourist service.

• The star category assigned to hotels and services, as they are based on the interpretation of The Silver XP and Direct Service Providers and may differ from categories reported elsewhere;
• The descriptions of the travel services are updated by The Silver XP to the best of your knowledge, but do not guarantee that everything will be exactly the same upon arrival;
• Any failure on your part to obtain the documentation required for your trip such as, but not limited to, passports, visas, vaccinations, permits, certificates etc.
• Any failure by You to follow travel instructions including, but not limited to, airport departure times, time and date of check-in and check-out at hotels, coupon redemption policies etc;
• Due to lack of financial conditions on the part of the Supplier to provide the service, in the event that the provider of the final service declares bankruptcy or bankruptcy and / or bankruptcy on strike, temporary or definitive suspension of activities in accordance with the legislation of Mexico or the countries where the services are provided and that for such reasons or any other similar has to stop providing the service, You agree that you will have to request the refund of the amount paid directly to the provider, since the final provider of the service is the one who has in his possession the amount paid by

  • Any failure or fault on the part of the Direct Provider in providing the service.
  • Any failure or fault on your part when enjoying the contracted services.

Misunderstandings on the part of you regarding the terms and conditions in which the service will be provided, since you understand that the only ones that will govern are those present and not any other that you believe you have received verbally or by telephone by any person, since those that will govern will always be those that you received in writing and these to be in force at the time of making your

At your insistence to make any type of trip, tourist activity, take a tour, excursion, take any type of air, land, sea and any type of transportation, under precarious health conditions or that are not optimal for the development of such activities, as well as the development by you of any type of extreme sports or activities that may involve any danger and that were carried out with your full knowledge, or when you suffer from any type of illness, medical condition, disability, any type of allergy, you are under medication or medical prescription, indications for rest and / or all those medical conditions that at your own risk were omitted and that could result in a deterioration to your health at the time of performing such activities under awareness of cause, under such occasions they will always be considered to have been made at your own risk, releasing You from The Silver XP with respect to any complaint, demand, complaint, nonconformity, reward, indemnity, compensation, compensation, claim for direct, indirect, punitive damages, courtesy, , derived from any incident caused during the development of any service or activity and any future event derived from the initial incident for any of these causes.

Full refund will not be applicable in situations where the trip has to be cancelled, interrupted and/or postponed by The Silver XP for reasons beyond its control (force majeure, such as, but not limited to, weather, hurricane, earthquakes, acts of terrorism, strikes, pandemics, bankruptcy or bankruptcy proceedings, suspension of activities, etc.) and in which The Silver XP’s contractual obligations to its suppliers do not allow it to obtain reimbursement of the sum paid or to be paid to the Supplier on behalf of the client. In case the correct price is less than the quoted amount, The Silver XP will apply the lower amount. In case the correct price is higher than the amount quoted, your assigned XPeer will promptly contact you, informing you of the correct amount or registering the cancellation of the reservation at your request for not agreeing with the price increase, expressly demarcating The Silver XP and its Suppliers from any liability or payment of indemnity for inconvenience caused by such cancellation. In the event that the contracted services could not be partially or totally provided by the Supplier, The Silver XP may only on certain occasions manage on your behalf the reimbursement of the appropriate amount, The Silver XP being relieved of any responsibility or greater commitment in cases where the reimbursement for the total or remaining amount is not reimbursed by the Supplier.

In cases that due to any error or manipulation by you of The Silver XP system an amount illogically less than the commercial value of the service offered is obtained, unless it is expressly offered as an extraordinary offer or as a promotion for being a frequent customer, The Silver XP may notify the tourist-client of the real and true price before the provision of the service, in order for the client to decide if he wishes to keep his reservation and if not, he accepts that the amounts he has paid, will be reimbursed in the same payment method that he has made, without responsibility for The Silver XP.

TERMINATION.- The Silver XP may terminate these Terms and Conditions and/or any of its services at any time without notice or notice of such termination, for any cause or reason, including for any improper use of this site or your breach of these Terms and Conditions. However, such termination will not affect any rights or obligations owed by The Silver XP to You upon confirmation of a reservation.

ASSIGNMENT.- You may not assign, subcontract, or delegate your rights, obligations or duties contracted herein.

SEVERABILITY.- These Terms and Conditions shall continue to be severable. In the event that any term or Condition is deemed prohibited or unenforceable, such provision shall nevertheless be binding and such determination shall not affect the validity and enforceability of any remaining provision.

TITLES.- The headings used in the Terms and Conditions are only used for your convenience and will not limit or otherwise affect the content of the Terms and Conditions set forth herein.

ENTIRE AGREEMENT.- These Terms and Conditions, which are included herein, or to which reference is made, constitute the entire and complete agreement between the parties in relation to the subject matter hereof, and supersede any previous agreement or contract made between the parties (whether oral or written) that is related to the same subject matter,  and shall not be amended or modified except in writing or by making such amendments or modifications available on this site.

APPLICABLE LAW.- These Terms and Conditions shall be governed by the laws of the state

of Quintana Roo. You declare that you know the scope of this Contract, whose Terms and Conditions are the faithful expression of your will and are submitted in the case of breach or interpretation to the competence of the Federal Consumer Protection Office, in the administrative channel, as a conciliatory instance, to resolve the differences that may arise and in case of subsisting the same You agree to submit to the jurisdiction of the Laws and Courts of Cancun, Quintana Roo, Mexico, under its exclusive jurisdiction, renouncing in turn any other jurisdiction that by reason of its present or future domiciles or the location of its assets or its nationality may correspond to it.
